Crashes Involving City, State, or Other Municipal Vehicles in New York City
Contact us if you were involved in a crash with a City or Municipal authority owned or operated vehicle such as:
- Fire Truck or Police Car
- Transit Authority or MTA Bus or Van
- Sanitation Vehicle or Street Cleaner
- City Owned Car or Truck
- Village or other Municipal Vehicle
- State Owned Car, Truck, or Construction Vehicle
Lawsuits against Municipal defendants have very unique and restrictive rules. Actions against the state, cities, counties, towns, and villages usually require the service of a Notice of Claim. Most importantly, if you are over 18 years of age, you often have only 90 days after you are injured to file a Notice of Claim that you intend to bring a lawsuit against these defendants.
For instance, if you are struck by a Fire Truck while riding your bike, you must file a Notice of Claim with the City of New York within 90 days, or you will lose the right to bring a lawsuit. (Sometimes a failure to timely file the Notice of Claim can be corrected if a special proceeding is brought within a year and ninety days of the collision).
The 90 day Notice of Claim requirement applies to many different types of cases against the City of New York, Counties of Nassau and Suffolk, Westchester, and the various towns and villages throughout the state. These may include falls or crashes due to roadway defects such as pot holes, vault, and other defective street hardware.
If you are injured by a municipality, you need a lawyer who is experienced in the handling of these claims. Flanzig and Flanzig has handled hundreds of claims against municipalities as far east as Montauk and as far North as Rockland. We have handled all types of lawsuits against municipal defendants, as a result of the negligence of these defendants causing injuries to riders.

The team here is nothing short of phenomenal. I reached out about my case on a Sunday afternoon from the hospital and we spoke before the evening was over. Since then, they have been happy to answer any question I have, and walked me through the entire process from handling my no-fault insurance to ultimately getting a settlement offer.
To any cyclist in search of a lawyer who understands the challenges of biking in this city, look no further than Daniel and his team.- Conor -
Almost 4 years ago I was struck by a delivery truck while on my bike and suffered a shattered wrist. Cathy Flanzig guided me through the process of bringing a suit against the company that owned the truck and the driver. Ms. Flanzig was professional and compassionate and realistic throughout the whole process. I am grateful to her and her firm for their expertise and diligence.- Kathe D.

Daniel Flanzig was with me on DAY ONE of my 2.5 year journey through the fractured legal system following a serious bicycle accident which left me with two broken wrists. The thirteen day hospital stay included surgeries on both, titanium plates implanted on both, and a severe challenge to my mental health and way of life. Unfortunately, I needed two
more surgeries on the significantly more damaged right wrist. Dan navigated me through the strained New York City Medical System, still struggling in late 2021 from the wrath of COVID. When the lawsuit needed to be moved to New Jersey, Dan seamlessly transferred the case to Joseph G. Hughes. Both men proved to be upstanding attorneys and outstanding human beings, emotionally invested in my traumatic, drawn-out experience, and committed to reaching the settlement deserved. After matters were resolved by Mr. Hughes, I received a call from Dan, closing this chapter of our time together, but cementing a lifelong connection filled with the utmost respect and gratitude.- Marty Keiser -
