Fees and Costs & Free Consultations

We speak to New York cyclists and provide free bike crash advice almost every day.

If a crash is serious enough, you may need to retain our office to represent your interests. It is important for us to discuss the details of the crash before we can determine whether we can be successful in making a recovery for you. We also want you to have a full and complete understanding of how the process works, and what you should expect so that there are no surprises along the way. If we believe we can successfully represent you, we will then enter into a retainer agreement pursuant to the Court Rules of the State of New York.

Pursuant to our retainer agreement, we charge you no money up front. We work on a contingency fee basis. This means we charge no fee unless we are successful in making a recovery for you whether by verdict or settlement. If and when we are successful, we then charge a one-third contingency fee, as well as reimbursement for our expenses from the award. If we are not successful in making a recovery for you, then there is no fee charged.

Unlike many other law firms, we will also handle your no-fault claim on your behalf for no additional fee. We will also pursue your property damage claim as part of the underlying case.

Typical expenses in a personal injury lawsuit include filing fees with the Court, deposition transcripts, investigation, medical records, experts, and other associated expenses necessary to prosecute your case. The largest expense would be when a case goes to trial, and we have to pay doctors and other experts to testify.

Some cases are more complicated, and expenses can be higher. Typical reasons why you might see increased expenses are the need for additional experts, such as for collision reconstruction, or where we need to have more than one doctor testify. At the conclusion of the case, all expenses are listed on a closing statement for you to review, which will ultimately be filed with the office of Court Administration.

When we accept your case, you can be sure that all of the resources and expertise of the firm will be committed to obtaining the highest recovery for you.
